How to manage the Shops and Establishments Act compliance for your office

The Shops and Establishments Act is state-specific legislation that regulates working conditions in commercial establishments — offices, shops, hotels, and similar premises. Every state has its own version with its own requirements, and every commercial establishment must register under the applicable state act.

Registration: register your establishment with the local labour department under the applicable state shops and establishments act. The registration certificate must be displayed at the establishment. In many states, registration must be obtained within 30 days of opening.

Working hours: the act specifies maximum working hours (typically 9 hours per day and 48 hours per week) and mandatory rest intervals (typically 30 minutes after 5 hours of work). Overtime work beyond these limits must be compensated at double the ordinary wage rate.

Leave entitlement: as covered in earlier guides, the act specifies minimum leave entitlement. Your company policy must meet the statutory minimum.

Women employees: the act in most states prohibits requiring women employees to work after specified hours (typically 9 PM or 10 PM) without specific consent and adequate safety provisions.

Annual renewal: most states require annual renewal of the shops and establishments registration. This is a routine but important compliance — operating without a valid registration certificate is a violation subject to penalties.

Inspections: shops and establishments inspectors may visit your premises to verify compliance. Ensure your registration certificate is displayed, your records (muster rolls, leave registers, salary registers) are maintained, and you can demonstrate compliance with working hours provisions.
